Ombudsman Complaint

Ombudsman Report Provided Closure

After taking legal advice, a decision was made to close the avenue of investigation with regard to bringing legal claims against Hairmyres Hospital. The Ombudsman's report and the 2 complaints that were upheld have provided a degree of closure.

Family Plan to Sue

We are in the process of taking advice on the next steps involved in taking legal action over the way the case was handled. This was published today in the Herald 'Family of man who died after misdiagnosis to sue', by jornalist Brian Donnelly and in it's sister newpaper The Evening Times 'Blood clot man’s family in legal move' and later on in the week, The East Kilbride News Family set to sue NHS Lanarkshire

Letter of Apology

On the 29th of January, Brian's family received a short apology letter from NHS Lanarkshire. In this letter an apology was offered 'for the failure of staff at the hospital to stress the importance to Brian of a hospital admission'. The letter also stated that 'we are presently reviewing the arrangements for the assessment of patients who attend Accident & Emergency services in Lanarkshire'.

STV News

There was further media coverage on the story today. STV News included a full report on Brian's death in their 6pm broadcast. The family were interviewed for this. Two articles were also been published on STV's local East Kilbride website: NHS to apologise and Family tell of amazing Brian. The family would like to thank STV news for their kind support and full understanding.

Ombubsman Report

You may be aware that the Scottish Public Services Ombudsman have been investigating the complaints made about the treatment that Brian received from Hairmyres Hospital on the night that he died. The outcome has been positive and the 2 complaints that were made have been upheld. There has been media coverage on the BBC, Stv,The Evening Times and a printed article in The Herlad. Brian's family would like to thank everyone for all their help and kind support during the 3 years of his illness

The family would also like to thank eveyone for their kind donations given at the retiral offering after the service. This raised a total of £560 and has been divided evenly between the Prince and Princess of Wales Hospice, Glasgow and the Kilbryde Hospice, East Kilbride.
